1. You Are the Sender and Publisher
Everything sent through the Service goes out in your name or your clients' names. As between you and BAL, you are the sender, advertiser and publisher of every email, video, landing page and message, for purposes of CAN-SPAM, state law and FTC rules. You choose the recipients, you choose the message, and you approve each campaign before it launches. If you resell the Service to your own clients (Sub-Customers), you answer for their use as you answer for your own. You may send for a Sub-Customer or any other third party only with a written agreement and the documented authorization of that party, which you keep and show to BAL on request, because BAL's sending providers require it.
2. Recipients and Lists
- Lawful basis. You have the right to contact every person on your lists and to give us their data.
- Opt-out. Every email shows who you are, your postal address and a working opt-out. You honor each opt-out within the time the law allows, and never later than 10 business days.
- Suppression. BAL applies a platform-wide suppression list automatically. You will not upload anyone on it and will not work around it.
- Regional rules. The Service is offered to recipients in the United States only. For a recipient in Canada or any other place outside the United States, follow the law of that place or do not send. Text messages go only to people who gave you their number and agreed to receive them.
- EU and UK gating. Do not upload or target anyone in the European Union, the European Economic Area, the United Kingdom or Switzerland. BAL geo-gates and may block those regions, and offers no processing for them until it adopts the transfer mechanisms the law requires.
- Email provider rules. BAL uses third-party email, domain and mailbox providers. You follow their acceptable-use, sending and anti-spam policies as BAL notifies you, and CAN-SPAM. You alone answer for your lists, content, consent and opt-outs. BAL may rate-limit, pause or suspend sending, with or without notice, if a provider requires it or deliverability is at risk, and does not guarantee inbox placement. You reimburse BAL for provider fees and penalties caused by your campaigns.
3. AI-Generated Presenter and Mandatory Disclosure
- The presenter is AI. BAL stock presenters are AI-generated. BAL burns this label into every frame of the presenter segment: "AI-generated presenter. No human performer is depicted." A Digital Twin video of a real, consenting person carries its own label, which names the person and says the video is used with permission. The exact wording of both labels is in Product Disclaimers v01 (www.b2bautoloop.com/legal/disclaimers).
- BAL adds three things. The on-screen label, a line in the email next to the video link ("Includes a short AI-generated video."), and machine-readable metadata in the video file.
- You keep them. You will not remove, crop, cover, blur, speed up or re-encode the label or the metadata. You will not re-post a video in a way that drops them, and you will not send a video that has lost its label.
- You stay honest. Never describe the presenter as a human, an employee or a customer. Add any further disclosure your own law requires.
4. Truthful Hooks and Claims
- Hooks must be true. Each opening line must rest on something real about the recipient or their company that you can point to.
- No invented proof. No fake testimonials, reviews, customers, case studies, statistics or results. The presenter never voices a testimonial or a results claim.
- No false familiarity. Do not say or suggest that the presenter watched, researched or met the recipient beyond what actually happened.
- Your claims, your proof. You must be able to support every claim in your messages. BAL does not check them for you.
5. Likeness and Voice Consent
- Stock presenters and voices. BAL supplies them. Use them only as provided. On the Launch plan they are the only option, and you cannot upload a face or voice.
- Digital Twin. A Digital Twin is available on Growth and Scale only. You may create a Digital Twin or voice clone only of an adult who personally consents in writing through BAL's capture flow: an identity check, a separate biometric consent screen and a recorded consent statement. An employer's permission is not enough. Never use anyone else's face or voice, and never a public figure's.
- Biometric notices. BAL gives the notice and collects the release. You will not bypass that flow or collect face or voice data outside it, and you will give the person any notice the law requires of you.
- Revocation and departure. If the person withdraws consent, leaves your organization, or you cannot show their consent, tell BAL at once. BAL stops using the Digital Twin, disables live links to videos that use it, and deletes the biometric data on the retention schedule in Section 8 of the Privacy Policy v06. You will not use that likeness or voice again.
7. What BAL Does and What You Remain Responsible For
| Topic | BAL does for you | You remain responsible for |
|---|---|---|
| AI disclosure | Applies the label and metadata to every presenter video | Keeping them, and any further disclosure your law requires |
| Quality | Runs automated quality checks on each render before it is sent | Reviewing and approving each campaign and every claim in it |
| Limits | Enforces your plan limits and spend ceilings | Choosing volumes and lists that fit the law |
| Opt-outs and deletion | Keeps the platform-wide suppression list and offers suppression and deletion tools; retention periods are in Section 8 of the Privacy Policy v06 | Honoring opt-outs that reach you by any other route, and keeping your lists clean |
| Consent | Runs the identity, biometric consent and AI-notice flows | Having the right to use any face, voice or data you supply |
8. No Guarantee of Results
BAL does not promise any reply, meeting, sale, inbox placement or lift. AI output can contain errors, so review it before you approve it. Analytics describe what happened in the past. Results vary and are not guaranteed.
9. Providers and Changes in Law
BAL uses third-party providers to run the Service and may change providers, models and features. Changes to sub-processors follow the notice terms in the MSA and the Privacy Policy. AI and advertising laws are changing fast. BAL may update the label, add steps, or pause a feature or region when the law or a provider requires it, and will tell you when it can. You agree to follow the updated rules.
10. Your Indemnity and BAL's Liability
If a third party brings a claim, or a regulator takes action, because of your lists, your messages or claims, your consent practices, a face or voice you supplied, or your breach of this Schedule, you will defend BAL and cover the resulting losses, as set out in Clause 7 of the Master Subscription Agreement v04 (the "Agreement"). BAL's total liability to you is limited as set out in the Agreement, which is the greater of the fees you paid in the 12 months before the claim and $500, and BAL is not liable for lost profits or other indirect damages. The Agreement lists the exceptions and controls if it differs from this summary. Billing and refunds: you are buying for your business, not as a consumer. You cancel online at any time (Account, Billing), and cancellation takes effect at the end of the period you paid for. If you cancel within 30 days of your first payment, BAL refunds the unused part of that first month's fee: the first-month fee divided by the days in that period, times the days remaining, once per account. This is not a free trial. It is the only refund right when you cancel, and there are no other refunds except as required by law. It does not apply to add-on purchases or to accounts suspended or ended for violations of the AUP. The full billing terms are in Section 10.4 of the Master Subscription Agreement v04 and in the Product Disclaimers v01.
